It is a sign of the times that most people know of the £50,000 protection limit provided by the Financial Services Compensation Scheme for funds on deposit. The Financial Services Authority has issued a consultation document proposing that protection is extended for certain categories of temporary high deposits, inclusive of personal injury awards. We shall be responding to the consultation in the terms outlined in the attached update.
Claimants seeking substantial interim payments in high value cases have long been frustrated, by arguments based upon the interim award encroaching into future losses and hence the discretion of the trial judge to make a periodical payments order. The Court of Appeal has considered the issues in Cobham Hire Services v Benjamin Eeles. The possible implications of the decision are included within our analysis as attached.
