Personal Injury Trusts - How can we help?

We provide free written assessments regarding the viability of Personal Injury Trusts. If we believe that a trust might be appropriate, a Partner will telephone the client to discuss their situation prior to providing a written assessment. In certain circumstances a Partner may be able to meet the client at their home.

If a Personal Injury Trust is viable and we are instructed to proceed, we shall establish the trust in accordance with the claimant's requirements.

Personal Injury Trusts are established on a fixed-fee basis and our service includes:

  • Arranging a suitably worded Trust Deed.
  • Setting up the Trust Bank Account.
  • Informing the Local Benefits agency (if applicable) of the creation of the Trust.

Should trustees require investment advice, we have specialist Partners to provide that service. Click here for further information about investment management.

Once a Trust has been established, it may be necessary to keep Trust accounts and submit tax returns to HMRC.

Nestor Accountancy Services specialise in this area - please click here for further details.

Nestor Partnership – A valuable member of the team.

Most of our Personal Injury Trust clients are introduced to us via their solicitors. We ensure that claimants’ solicitors are kept fully informed of our Trust advice by the provision of copy correspondence. We ensure that referrals are provided where applicable. For instance, claimants may require a professional trustee, a will or legal advice regarding separation or divorce.

During a recent 12-month period we helped to establish over 250 Personal Injury Trusts, and client feedback on our service and client care is superb, but we are not complacent.  We strive always to improve our client communication and the quality of service we offer.

We value the relationships we have with our professional connections and we ensure reciprocation wherever possible.

Legal teams can be assured that when a client is introduced to Nestor Partnership we will look after them and ensure their best interests are our priority. Click here to read Nestor Partnership’s policy on Treating our Customers Fairly.

We also offer training to legal advisers on the use of Personal Injury Trusts.  We are registered with the Solicitors Regulation Authority and the Bar Council for Continuous Professional Development (CPD) purposes.  Please click here for a copy of our Training and Education programme .

We are also able to provide legal firms with model paragraphs for use within client care letters, or standard letters for when claims are due to conclude. Click here to find out more.

Please note that the Financial Services Authority do not regulate taxation or trust advice.
